1. Acceptance of Terms

By accessing or using SocialHipper ("the Platform"), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, do not use the Platform.

2. Description of Service

SocialHipper is an influencer marketing platform that connects brands and advertisers with influencers. The Platform provides influencer discovery, social media analytics, audience insights, campaign management, and payment processing services. SocialHipper integrates with third-party services including Google (YouTube), Meta (Instagram/Facebook), and Pinterest to provide analytics and authentication features.

3. User Accounts

You must provide accurate information when creating an account. You are responsible for maintaining the confidentiality of your credentials and for all activities under your account. You must be at least 13 years of age (or 16 in the EU/EEA) to create an account.

4. User Roles

Influencers may claim profiles, connect social media accounts, create media kits, browse campaigns, and receive payments for completed work. Advertisers may create campaigns, discover influencers, manage deliverables, and fund escrow payments.

5. Social Media Account Connections

When you connect a social media account (YouTube, Instagram, or Pinterest) to SocialHipper:

  • You authorize SocialHipper to access the data described in our Privacy Policy through the respective platform's API.
  • You represent that you are the owner or authorized manager of the connected social media account.
  • You may disconnect any connected account at any time from your profile settings, which will revoke our access.
  • You acknowledge that the availability and accuracy of third-party data depends on the respective platform's API and is subject to their terms of service.

Your use of SocialHipper in connection with third-party platforms is subject to their respective terms:

7. Campaign & Payment Terms

Campaign payments are held in escrow until deliverables are approved. SocialHipper charges a service fee on completed campaign transactions. Disputes are handled through our resolution process. Payout timelines and methods are detailed in the campaign agreement.

8. Prohibited Conduct

You may not:

  • Use the Platform for illegal activities or to promote illegal content
  • Manipulate engagement metrics or misrepresent social media statistics
  • Create fake accounts or impersonate others
  • Circumvent the payment system or arrange off-platform payments to avoid fees
  • Scrape, crawl, or collect data from the Platform without express written authorization
  • Harass, threaten, or abuse other users
  • Use automated systems (bots) to access the Platform beyond authorized API usage
  • Reverse engineer, decompile, or attempt to extract the source code of the Platform
  • Use data obtained from the Platform's integrations with Google, Meta, or Pinterest in violation of their respective developer policies

9. Intellectual Property

Content you create remains yours. By posting content on SocialHipper, you grant us a non-exclusive, worldwide, royalty-free license to display, reproduce, and distribute your content on and in connection with the Platform. SocialHipper's branding, design, code, and technology remain our exclusive property.

10. Limitation of Liability

SocialHipper is provided "as is" without warranties of any kind, express or implied. We do not guarantee the accuracy of social media data retrieved from third-party APIs. We are not liable for indirect, incidental, or consequential damages. Our total aggregate liability is limited to fees you paid to SocialHipper in the prior 12 months.

11. Indemnification

You agree to indemnify and hold SocialHipper harmless from claims, damages, or expenses arising from your use of the Platform, violation of these Terms, or infringement of any third party's rights.

12. Termination

We may suspend or terminate accounts that violate these Terms or applicable laws. You may close your account at any time. Upon termination:

  • Outstanding payment obligations survive termination.
  • We will delete your personal data and revoke connected social media tokens within 30 days, except where retention is required by law.
  • Campaign content and completed deliverables may be retained as necessary for business records.

13. Governing Law & Disputes

These Terms are governed by the laws of India. Any disputes shall first be attempted to be resolved through good-faith negotiation, then through binding arbitration if not resolved within 30 days.

14. Changes to Terms

We may update these Terms periodically. Continued use after changes constitutes acceptance. Material changes will be communicated via email or Platform notification at least 14 days before they take effect.
